The campaign for Las Vegas Ward 1 candidate Sherman Ray is contemplating a court action challenging the residency of one of his opponents, Dave Marlon.

A complaint filed with the Nevada Secretary of State last week by Ray’s campaign consultant Lisa Mayo DeRiso was lodged too late to warrant an investigation, according to a letter from the SOS.

The letter says the deadline to challenge a municipal candidate’s right to run was February 11.

“This leaves a private civil action as your only legal option to impose the remedies you seek under NRS 293C.1865,” says the letter from the state.

DeRiso told the Current she intends to file a legal action after meeting with an attorney Thursday.

“The integrity of our election is the key point of this challenge,” said Mayo DeRiso in a news release. “Documentation and physical evidence bring the permanency of residency in Ward 1 by Mr. Marlon into question. The voters in Ward 1 have a right to honest and transparent information on all candidates.”

Ray and Marlon are two of three candidates in the Ward 1 race who have failed to file financial disclosure forms due February 11.  The third candidate is Drew Dondero.

There are a total of ten candidates in the race. The other seven are Robert Blakeley, Amy Emanuel, Jesse Holder, Brian Knudsen, Dean Lauer, Robin Munier, and Margarita Velazquez Rebollal.
